EkoCardia SMS Terms & Conditions

Applies to: SMS/MMS text messages used for diagnostic imaging appointment communications.

1) Consent to SMS Messaging

By providing your mobile number and opting in, you consent to receive SMS/MMS messages from EkoCardia related to your diagnostic imaging appointments (e.g., confirmations, reminders, schedule changes, and limited follow-ups). Consent is not a condition of receiving care. You may opt out at any time (see Section 6).

2) Message Frequency & Content

You may receive messages for:

Appointment confirmations and reminders
Pre-visit instructions (e.g., arrival time, preparation)
Scheduling changes or rescheduling prompts
Limited post-visit follow-ups (e.g., satisfaction check-in or instructions)
Frequency may vary based on your appointment activity.

3) Costs

EkoCardia does not charge for SMS messages; however, standard message and data rates may apply according to your mobile carrier plan.

4) HIPAA & SMS Security Notice (Important)

SMS is not encrypted. While we strive to protect your privacy, text messages may be visible to your carrier, phone manufacturer, or anyone with access to your device.

We will limit messages to the minimum necessary information for appointment-related purposes.

Please do not text sensitive health details (PHI)—such as test results, diagnoses, or full medical histories.

For clinical questions, results, or detailed medical information, please call us or use our secure patient portal.

By opting in, you acknowledge and accept the inherent privacy risks of SMS and authorize EkoCardia to communicate appointment-related information via text.

5) Privacy: Information We Collect & How We Use It

Information collected:

Your mobile number, device/carrier details, message content (limited to appointment context), timestamps, delivery status, and your replies (e.g., YES/STOP/HELP).

How we use it:

To send appointment confirmations, reminders, updates, and respond to your SMS inquiries.
To improve scheduling efficiency and communication quality.
To maintain records of opt-in/out for compliance.

Data sharing:

We do not sell, rent, or share your mobile opt-in data with third parties for their own marketing purposes
We may share mobile messaging data with contracted service providers (e.g., messaging platforms) only to deliver messages and support our program, and as required to comply with law or legal process.
We follow applicable privacy laws and EkoCardia policies. Vendors are required to safeguard your information.

6) Opt-Out/Unsubscribe

You can opt out any time by replying STOP to any message. You will receive one final confirmation message and then no further texts.
For help, reply HELP or contact us using the details in Section 10.

7) Your Responsibilities

Keep your mobile number up to date. If your number changes, notify us immediately.
Protect your device with a passcode/biometrics and avoid sharing your phone to help keep messages private.
Do not send sensitive medical information via SMS.

8) Service Availability & Changes

Carrier delivery is not guaranteed; messages may be delayed or undelivered. EkoCardia may modify or discontinue the SMS service at any time. Continued use after updates constitutes acceptance of the revised terms.

9) Your Rights

Access/Correction: You may request access to or correction of your contact information.

Opt-Out: You may opt out at any time (Section 6).

Questions: You may contact us to inquire about our handling of your SMS data (Section 10).

11) Arbitration/Class Action Waiver

Any disputes arising from this SMS service may be resolved by binding arbitration on an individual basis. You and EkoCardia waive rights to a jury trial and to participate in a class action. Details of the arbitration process will be provided upon request.

12) Updates to This Statement

We may update these Terms & Conditions and Privacy Statement periodically. The “Effective Date” will change when updated. Material changes will be communicated through reasonable means (e.g., website/posting).
